Terms of Service

These terms are an agreement between you and InkSpred Ltd (“InkSpred”, “we”, “us”), a company registered in England & Wales. They govern your use of the InkSpred website and mobile app (the “Service”). By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use the Service.

1. What InkSpred is — and is not

InkSpred is a software platform and payments facilitator that connects customers with independent tattoo artists and studios and helps them manage enquiries, bookings, deposits and payments.

InkSpred does not provide tattoo services and is not a party to the tattoo itself. The tattoo is a contract between you and the independent artist or studio you book with. They are responsible for the work, its safety and quality, their hygiene and licensing, and their own policies. InkSpred provides the tools that sit around that relationship — it does not perform, supervise or guarantee the artwork.

InkSpred is not a lender and does not offer credit. See section 3.

2. Eligibility — 18+ only

You must be aged 18 or over to use InkSpred. Tattooing anyone under 18 is a criminal offence in the UK (Tattooing of Minors Act 1969) and there is no parental-consent exception. You confirm you are 18 or over when you register and when you book. A booking made with a false age declaration is void, and any deposit may be forfeited in line with the artist’s stated policy. We may ask you or the artist to verify age and will remove accounts we believe belong to under-18s.

3. Deposits, plans and payments — not credit

Payments are processed by Stripe. Money moves into the artist’s or studio’s own connected account, less an InkSpred platform fee. InkSpred does not hold your money as a general float.

Deposits and InkSpred Plans are prepayments, not credit. A deposit secures the artist’s time and design work. An InkSpred Plan lets you pay toward a booked tattoo over time (a form of layaway): it carries no interest, no late fees and no penalty charges, creates no debt, and you receive the tattoo only once it is fully paid for. A missed or delayed payment simply pushes back your session — it never creates a charge or a liability.

Where a regulated instalment-credit option (such as Klarna) is offered at checkout, that third-party provider is the lender, makes all credit decisions, and owns that relationship with you under its own terms. InkSpred only presents it as a payment method and is not responsible for its lending decisions.

4. Deposits, release and refunds

Each artist sets their own deposit and cancellation policy, which is shown to you before you pay and which you acknowledge at that point. These are the high-level principles; the full detail is governed by the artist’s stated policy and our payment-scenarios policy:

  • Deposits are normally non-refundable. A deposit compensates the artist for design, consultation and the diary slot held for you. It may be forfeited if you cancel late or do not attend.
  • Release is triggered by the session, not by goodwill. Funds you have paid toward the work are released to the artist when the booked session is completed — either when you confirm it, or automatically a short time (around 48 hours) afterwards unless you raise a dispute in that window. Multi-session pieces release proportionately as each sitting is completed.
  • If the artist is at fault — they cancel, fail to appear, or cannot perform — you are made whole: everything you paid, including the deposit, is refundable, or you can choose to rebook.
  • Before your session, money you have paid toward the work (beyond the deposit) is generally refundable, because the work has not happened.
  • A completed, permanent tattoo cannot generally be refunded once it matches the agreed design. Genuine disputes — such as work that materially departs from what was agreed — pause release and are reviewed on the documented record.

Deposits and refunds are always subject to the specific artist’s stated policy, shown to you before you pay.

5. Acceptable use and your content

You agree to use InkSpred lawfully and respectfully. When you upload content — messages, reference images, portfolio work, reviews — you keep ownership of it, but you grant InkSpred a licence to host and display it as needed to run the Service.

You must not use InkSpred to:

  • post unlawful, fraudulent, harassing, hateful or defamatory content;
  • upload sexually explicit, abusive or otherwise objectionable material, or content that infringes someone else’s rights;
  • impersonate another person or business, or misrepresent your identity, age or qualifications;
  • attempt to arrange or take payment for tattooing a person under 18, or any other unlawful service;
  • circumvent our payments, spam other users, or interfere with the security or operation of the Service.

6. Zero tolerance for objectionable content and abusive users

InkSpred operates a zero-tolerance policy toward objectionable content and abusive behaviour. We reserve the right, at our sole discretion and without prior notice, to remove any content and to suspend or terminate any account that breaches these terms or that we reasonably consider objectionable, abusive, unsafe or unlawful. You can report content or a user from within the app; we aim to act on reports of objectionable content promptly and to remove offending material and eject the user responsible. This section applies to all user-generated content, including messages, images, portfolios and reviews.

7. Reviews and disputes

Reviews must relate to real, completed bookings. Artists have a right of reply. We may remove reviews that are abusive, defamatory or not tied to a genuine booking, but honest criticism will stand. Money and reviews are kept separate: a review never determines whether funds are released or refunded. Payment disputes are decided on the documented record (the agreed design, quote, consent acknowledgement and message thread).

8. Third-party services

The Service relies on third parties including Stripe (payments), Klarna or similar (where you choose regulated instalment credit), and mapping providers. Your use of those services is also subject to their terms. InkSpred is not responsible for third-party services beyond integrating them in good faith.

9. Disclaimers and limitation of liability

The Service is provided “as is”. Because InkSpred does not provide the tattoo, we are not liable for the tattoo itself — its quality, safety, healing or outcome — which is the responsibility of the independent artist or studio.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your non-excludable rights as a consumer under the Consumer Rights Act 2015. Subject to that, to the fullest extent permitted by law InkSpred is not liable for indirect or consequential loss, and our total liability to you for any claim relating to the Service is limited to the total platform fees you paid to InkSpred in the twelve months before the claim.

10. Suspension and termination

You may stop using InkSpred and delete your account at any time from Settings → Delete account. We may suspend or terminate your access if you breach these terms, as described in section 6, or where we must do so to comply with the law. Terms that by their nature should survive termination (such as liability, and payment obligations already incurred) will continue to apply.

11. Changes to these terms

We may update these terms from time to time. If we make a material change, we will give you reasonable notice through the app or by email. Continuing to use InkSpred after a change means you accept the updated terms.

12. Governing law

These terms and any dispute arising from them are governed by the law of England & Wales, and the courts of England & Wales have jurisdiction, without affecting any mandatory consumer protections available to you where you live.
